And on the other hand any natural or legal person wishing to make a purchase via the website www.artjl.fr, hereinafter named the buyer.

Object

The present conditions of sale aim to define the contractual relations between ArtJL and the buyer and the conditions applicable to any purchase made through the ArtJL merchant site, whether the buyer is professional or consumer.
The ArtJL merchant site is at the following internet address: https://www.artjl.fr.
The acquisition of goods through this site implies an unconditional acceptance by the buyer of these conditions of sale.
These conditions of sale will prevail over any other general or specific conditions not expressly approved by ArtJL.
ArtJL reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Price

The seller reserves the right to modify its conditions of sale at any time. The price and conditions applicable to the order are those in force during the validation by the customer of the order.

Payment

All the prices indicated on the site are in euros inclusive of tax, excluding transport costs.
The applicable VAT is that in force on the day of the order; any rate change may be reflected in the price of the products.
The buyer can make a secure payment by credit card / visa, by Paypal, or by bank transfer.
In the case of a tailor-made service, a non-refundable deposit may be requested.

Ordered

The buyer who wishes to buy a product via the ArtJL site must follow the ordering process for said site.
The confirmation of the order implies acceptance of these conditions of sale and the recognition of having perfect knowledge of them.
All the data provided and the confirmation recorded will constitute proof of the transaction, signature and acceptance of the operations carried out.

Retractation

In accordance with article L 121-20 of the consumer code, the buyer, a non-professional natural person, has a withdrawal period of 7 (seven) days from the delivery of their order to return the product to the seller for exchange or refund without penalty except for return costs.
The buyer declares that these general conditions of sale comply with the provisions of articles L 111-1 and L 113-3 of the consumer code in that the site and said general conditions of sale inform him of the essential characteristics of the product, on prices, limitations of liability; contractual and the conditions of the sale.
The articles concerned must be returned in their original packaging, intact, not soiled, without trace of use and accompanied by any instructions for use.
The shipping and return costs will then be borne by the buyer.
Shipments against reimbursement will not be accepted.
Only the price of the returned product will be refunded. The initial shipping costs remain the responsibility of the buyer.

Depending on the nature of the product sent (fragility, value, weight), ArtJL reserves the right to choose the shipping method. Packages are sent by Colissimo monitoring (deadlines noted in principle 48h for France) or by carrier (deadlines observed in principle 24 / 72h for France). These deadlines are given as an indication insofar as they are not the responsibility of ArtJL.
When sending Colissimo, the buyer will receive an email indicating a parcel number allowing him to track it on www.coliposte.net.

– Canvas:
The order processing time by ArtJL is in principle 72 hours maximum.
The delivery time is in principle 72 hours maximum.
Depending on the nature of the product sent (fragility, value, weight), ArtJL reserves the right to choose the shipping method. The processing time for a tailor-made service by ArtJL is to be defined on a case-by-case basis. It will be indicated on quote and valid once said quote dated and signed, and the deposit received.
Delivery times can in no way be enforceable against ArtJL, but in the event of an unusual delay, an email will be sent to the buyer.

ArtJL declines all responsibility in the event of excessively long delivery times due to postal services or means of transport.
Our transporter makes the delivery to the bottom of your building (or house).
Delivery to the floors is not provided for in its delivery.

In the case of an order comprising products with different deadlines, the processing and shipping time of the order is aligned with the longest time.

The goods always travel at the buyer’s risk and peril from the moment the products have left the premises of ArtJL.
The buyer must check the good condition of the goods upon arrival of the package.
In the event of an anomaly (missing or broken product, punctured, opened or damaged package), the buyer must imperatively refuse the package and note a reservation on the delivery slip (package refused because opened or damaged).
The buyer must make a reasoned complaint to the postal services or to the carrier, within 48 hours of delivery and by LRAR.

Any anomaly concerning the delivery must imperatively be notified to ArtJL the same day of the reception or at the latest the first working day following the reception.

Any claim made after this period will be rejected and ArtJL will be released from all liability.
ArtJL reserves the right to ask the buyer to return the defective product to him.
If the above conditions are met, ArtJL will then either exchange or refund the defective product (s), or reship the missing product (subject to the merits of the buyer’s request) .

Characteristics of the goods offered on the site

ArtJL offers a selection of lamps, and artistic creations.
It is expressly specified that these lamps and artistic creations are intended for decoration.
Consequently, they can present a risk within the framework of a use other than decoration, in particular in the hands of young children for a use of traditional toy.
The buyer therefore declares that he is fully informed of this risk and ArtJL cannot be held liable for any damage resulting from the use of the goods sold that do not comply with its decoration destination.

Responsibility

As indicated above, and more generally, ArtJL, in the online sales process, is only bound by an obligation of means.
ArtJL cannot be held liable for damage resulting from the use of the Internet such as loss of data, intrusion, virus, breakdown of the service, or other involuntary problems.
Specifically, ArtJL’s responsibility cannot be sought for damage resulting from the use of the goods sold that do not comply with its decoration destination.
ArtJL cannot be held liable in the event of non-compliance with the legislation of the country where the article is used (censorship, prohibition of a title, of an author).
The characteristics of our products are subject to change or improvement at any time. The texts and photographs contained in the online store and illustrating the articles presented do not enter into the contractual field.

Confidentiality

These general conditions of sale are subject to French law.
